These Terms of Service ("Terms") are a binding agreement between you ("you" or "User") and Turbo Scale LLC, a Wyoming limited liability company ("Turbo Scale," "Company," "we," "us," or "our"), governing your access to and use of trytellr.app and the "Tellr" soulmate sketch and spiritual guidance service (collectively, the "Service"). By creating an account, submitting your information, or making a purchase, you accept these Terms in full. If you do not agree, do not use the Service.
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service.
Tellr is provided strictly for entertainment purposes. All soulmate sketches, astrology readings, love guides, zodiac-based insights, and related content ("Content") are creative, fictional, and speculative in nature. Content is not, and should not be relied upon as, psychological, medical, financial, legal, or professional advice of any kind, and does not predict or guarantee any real-world outcome, relationship, or event. No sketch or reading depicts an identifiable real person; any resemblance to any actual person is coincidental. We make no claim that any Content is factually accurate, and you should not make significant life, financial, medical, or relationship decisions based on it. If you are experiencing a medical or mental health crisis, contact a licensed professional or emergency services.
Tellr offers a guided quiz experience that generates a personalized "soulmate sketch" and accompanying reading, delivered by email, along with related astrology-themed content and features made available through your account.
PLEASE READ: THIS SERVICE INCLUDES AN AUTOMATICALLY RENEWING SUBSCRIPTION.
Introductory Trial: By providing your payment information and completing checkout, you authorize an immediate charge of $1.00 USD for a 7-day trial of the Service.
Automatic Renewal: Unless you cancel before your 7-day trial ends, your payment method will automatically be charged $29.99 USD every 28 days on a recurring basis, for a continuing subscription to the Service, until you cancel.
Your card will be charged automatically on each renewal date without further notice or action from you, using the payment method on file. Prices are subject to change with advance notice as required by law; continued use after a price change constitutes acceptance of the new price.
By completing your purchase, you affirmatively and expressly consent to this automatic renewal / negative option billing arrangement, acknowledge the material terms above, and authorize Turbo Scale LLC (or its payment processor) to charge your payment method as described.
You can cancel your subscription at any time, with no phone call, hidden steps, or retention gauntlet required. To cancel:
Cancellation stops all future charges effective at the end of your current billing period. We do not require you to speak to a representative, navigate a multi-step retention flow, or take any action beyond what is described above to cancel.
All sales are final. Payments, including the introductory trial charge and any recurring subscription charges, are non-refundable, except where required by applicable law or where we, in our sole discretion, elect to issue a refund. Canceling your subscription stops future charges but does not entitle you to a refund of any amount already charged. If you believe you were charged in error, contact support@turboscale.io. The Service, including all Content, software, designs, text, graphics, logos, and the "Tellr" name and marks, is owned by Turbo Scale LLC or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial use, subject to these Terms. All other rights are reserved.
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT WILL BE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURBO SCALE LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Turbo Scale LLC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any Content or information you submit to the Service.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
Except for disputes that qualify for small claims court, you and Turbo Scale LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual action in small claims court.
CLASS ACTION WAIVER: YOU AND TURBO SCALE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to support@turboscale.io within 30 days of first accepting these Terms, identifying your name, account email, and a clear statement that you wish to opt out of arbitration.
These Terms and any dispute not subject to arbitration are governed by the laws of the State of Texas, without regard to its conflict of laws principles, and, to the extent judicial proceedings are permitted under Section 12, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Texas.
We may update these Terms from time to time. Material changes will be effective upon posting the revised Terms to this page with an updated effective date, and, where required by law, additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Turbo Scale LLC regarding the Service.
